Novozymes European animal feed patent revoked

European Patent Office’s (EPO) Technical Board of Appeal has recently rejected Novozymes (OMX: NZYM B) appeal and thus rules for Danisco in revoking Nozymes’ animal feed enzyme patent 1,804,592 (EP'592) throughout Europe. Danisco A/S is now a part of E I Du Pont De Nemours And Co aka DuPont (NYSE: DD). The patent was about using steam pelleting containing salt-coated enzyme granules in animal feed manufacturing.

EPO had initially ruled in a similar manner around one year ago and Novozymes was appealing that decision. It had also tried to enforce the patent across multiple geographies, which led to legal proceedings. Danisco is now expected to be compensated for its legal fees and will also seek damages from a preliminary injunction obtained by Novozymes in Denmark. The two companies have a long history of patent litigation with victories going each way. Novozymes does not expect an effect on 2012 accounts from the ruling.
